1. Taxation Γ’€” Separation of timber and land for tax purposes. Pursuant to practice and custom the timber was assessed for taxes separately from the land. 2. Quieting title Γ’€” Strength of title. In action to quiet title, plaintiff must prevail only on the strength of her own title and not on the weakness of that of her adversary. 3. Abandonment Γ’€” Intent is primary element. The primary element of abandonment is the intention to abandon, which intention may be shown by declarations or conduct of the party who it is claimed abandoned the rights. 4. Logs and logging Γ’€” Abandonment sustained in case at bar. A transferee of grantee under a conveyance of timber rights abandoned all his rights thereunder, where obligation assumed by grantee for extension of time to remove timber was that he pay taxes on the land and transferee failed to pay taxes on the timber since 1928, and allowed the rights to be sold for delinquent taxes and made no offer to redeem, and stating to assessor that the land was sold.
